Potency and Overdose Risks
The risks associated with kratom products are increasing due to the presence of concentrated alkaloids. According to the Utah Poison Control Center in a July 22 report, adulterated products, such as certain Cat’s Claw and Kava products, may cause opioid overdoses. This risk is heightened by the presence of 7-hydroxymitragynine (7-OH), a naturally occurring alkaloid in the kratom plant that is significantly more potent than the plant's primary alkaloid, mitragynine.
While 7-OH is a minor constituent making up less than 2% of the total alkaloid content in natural kratom leaves, it demonstrates substantially greater mu-opioid receptor potency than mitragynine and other classical opioids like morphine. The Utah Department of Agriculture and Food notes that products containing 7-OH at a concentration greater than 0.4% of the alkaloid fraction are considered illegal. Furthermore, any products containing synthetic alkaloids, such as synthetic mitragynine or synthetic 7-hydroxymitragynine, are prohibited.
Utah Regulatory Standards
The Utah Department of Agriculture and Food (UDAF) oversees the manufacturing and sale of specialized products, including kratom, tobacco, and cannabinoids. The UDAF Kratom Program is designed to protect consumer health by enforcing standards set by the Utah Kratom Registration Act, which includes registering and inspecting all kratom products sold within the state.
To ensure safety, the UDAF Specialized Products Division requires that kratom can only be sold from a Specialty Tobacco Retail Business with a license that specifically covers kratom. Consumers are advised to only purchase pure leaf kratom that appears on the state's Registered Product List. These listed products have undergone review and testing to ensure compliance with state safety and labeling standards.
Federal Regulatory Status
The Food and Drug Administration (FDA) has maintained that kratom is not appropriate for use as a dietary supplement. The agency has concluded that kratom is a new dietary ingredient for which there is inadequate information to provide reasonable assurance that it does not present a significant or unreasonable risk of illness or injury. Consequently, dietary supplements containing kratom are considered adulterated under the FD&C Act.
Additionally, the FDA has determined that kratom is an unsafe food additive and cannot be lawfully added to conventional foods.
