A judge in St. George has denied a request from prosecutors to remove the presiding official in the rape case against former BYU football player Parker Kingston.
Fifth District Court Presiding Judge John Walton ruled that prosecutors failed to demonstrate grounds for disqualifying Judge Jay Winward, noting that disagreements with judicial decisions were not sufficient for removal.
The ruling follows an attempt by prosecutors to have the judge overseeing the Kingston case removed from the proceedings.
According to the ruling by Judge Walton, the arguments presented by prosecutors did not meet the requirements necessary to disqualify Judge Winward.
