David N. Mortensen (ballot name David Ned Mortensen) is Associate Presiding Judge of the Utah Court of Appeals, appointed in May 2016 by Gov. Gary R. Herbert and assuming office on July 14, 2016. He previously served nearly ten years as a Fourth District Court trial judge, including as presiding and associate presiding judge, after private practice as a trial attorney, and earned a J.D. from Brigham Young University’s J. Reuben Clark Law School in 1993. He has taught as an adjunct professor at that law school, serves on the Utah Judicial Council, is a Fellow of the American Bar Foundation, and is on the November 3, 2026 nonpartisan retention ballot for the Court of Appeals.
