Brigham Young Merrell and Melinda Marie Merrell were released from the Box Elder County Jail earlier this week after prosecutors did not file formal charges within Utah's required 72-hour window following their May 6 arrest.
The couple was arrested in connection with the September 21, 2025, death of their 11-year-old son, Moroni Merrell. Brigham Young Merrell, 35, was booked on investigations involving child abuse, homicide, and child torture, while Melinda Marie Merrell, 36, was arrested for investigation of child torture, according to KSL reporting.
The Box Elder County Attorney’s Office stated that the arrests were made before prosecutors could complete a full legal review of the evidence. Prosecutors noted that police independently decided to make the arrests before submitting the cases for review, and the volume and complexity of the evidence prevented a completed review within the statutory filing period.
The Tremonton-Garld Police Department stated that detectives spent months investigating the child's death with assistance from outside agencies. Police Chief Dustin Cordova said investigators conducted a thorough investigation and made lawful arrests based on probable cause, adding that the completed investigative file was submitted to the Box Elder County Attorney’s Office.
The County Attorney’s Office reported that while they had initial conversations with police after the child's death in September 2025, there was limited communication and coordination following the start of the criminal investigation. Prosecutors also noted that when the case file was eventually received, it was missing some assisting reports.
Under Utah law, prosecutors must generally file charges by 3:00 p.m. on the fourth calendar day after a defendant is booked, though extensions can be requested for good cause. KSL legal analyst Greg Skordas noted that while the parents were released, they could still face charges and rearrest once the review is complete.
