PUBLIC HEARING

The public hearing is scheduled during the TOWN COUNCIL’s regular meeting.

The purpose of this hearing is to receive public input on proposed amendments to Boulder Town Code Chapter 112 and Section 153.204 (Residential Short-Term Rentals), Chapter 110 (General Business Provisions), and Chapter 111 (Alcoholic Beverages). These revisions reflect prior deliberations by the Planning Commission and Town Council, incorporating legal counsel recommendations to enhance administrative clarity, enforceability, and permitting workflows where applicable.

These draft ordinances are predicated upon formal recommendations submitted by the Planning Commission to the Town Council, following their public hearing and subsequent deliberations held on August 18, 2026. A transmittal report summarizing their findings is included in the materials packet.

Additionally, the hearing is to receive public input on proposed amendments to Boulder Town Code Chapter 130 (Fire Restrictions). These revisions address the historical need to pass annual resolutions to extend fire restrictions by amending the default annual restriction period to May 1 through October 31, with provisions for adjustment by resolution. Furthermore, the amendments align the town's definitions and prohibited acts with the Stage 1 and Stage 2 restrictions used by the State of Utah Division of Forestry, Fire, and State Lands and Unincorporated Private Property in Garfield County, reflecting deliberations held by the Town Council in March and April 2026.
