Nebo School District maintains a formal policy, JDCB, to protect students and employees from sexual harassment. The district is committed to an educational environment where all individuals are treated with dignity and respect, prohibiting conduct that violates Title IX of the Education Amendments of 1972.
Defining Sexual Harassment Conduct
The policy covers conduct by students, employees, volunteers, or others under the district's control. Sexual harassment is defined to include quid pro quo harassment and unwelcome conduct that is severe, pervasive, and objectively offensive, effectively denying equal access to educational programs. The policy also encompasses instances of sexual assault, dating violence, domestic violence, and stalking.
Reporting Responsibilities and Procedures
Under the guidelines, any school employee who becomes aware of potential sexual harassment has a responsibility to report the conduct to the Title IX Coordinator or the Human Resource Officer. For students, administrators are required to contact parents when investigating allegations of sexual conduct.
Available Support for Complainants
The district provides supportive measures to complainants, which may include counseling, modifications to class schedules, or campus escort services. These measures are non-disciplinary and designed to restore equal access without unreasonably burdening either party.
Investigation Process and Determinations
Investigations are conducted by designated investigators, such as the Human Resource Officer or other trained individuals. The process includes a notice of allegations, interviews with relevant parties and witnesses, and the preservation of evidence like surveillance footage or electronic communications. A decision-maker, who cannot be the investigator or the Title IX Coordinator, will issue a written determination based on the preponderance of the evidence.
Retaliation and Disciplinary Consequences
The district prohibits retaliation against anyone participating in an investigation and may take disciplinary action against those found to have engaged in sexual harassment. For students, consequences may include suspension or expulsion, while employees may face actions ranging from warnings to termination. The policy also notes that intentionally false or malicious complaints will result in corrective or disciplinary action against the complainant.
