Huntsville Mayor Richard Sorensen released a letter to residents providing an update on the Powder Landing rezone request and the town's recent legal reviews. The town previously tabled the issue indefinitely to investigate concerns raised by the community.
The request involves Powder Mountain seeking to rezone the Powder Landing property from R-1 Residential to RC Recreation, accompanied by a proposed restrictive development agreement. In response to resident concerns, the town commissioned two independent legal reviews. The first was prepared by attorney Bill Morris on July 8. A second review was conducted by Robert A. McConnell of Parr Brown Gee & Loveless, who provided a memorandum on August 24.
The town also compiled a 200-page supplemental research analysis. This research examines the Huntsville Town Code under four scenarios: R-1 Residential zoning without a development agreement, R-1 Residential zoning with a development agreement, RC Recreation zoning without a development agreement, and RC Recreation zoning with a development agreement.
Mayor Sorensen stated the Powder Landing request will likely return to a Town Council agenda within the next month or two. The topic will be included on a publicly posted agenda at that time.
